Terms of Use
These Terms of Use (“Terms”) govern your access to and use of the website operated by Advanced Foundry Tech LLC, a California limited liability company (“Advanced Foundry Tech,” “Company,” “we,” “us,” or “our”), including the website located at advancedfoundrytech.com and its associated webpages (collectively, the “Website”).
By accessing or using the Website, you agree to these Terms. If you do not agree to these Terms, do not use the Website.
1. About Advanced Foundry Tech
Advanced Foundry Tech develops and operates software, technology products, online services, and related solutions.
The Website provides information regarding Advanced Foundry Tech and its products and services and may allow visitors to contact us, request information, submit ideas or business needs, or access websites and services operated by Advanced Foundry Tech.
Individual products and services may be subject to separate terms of service, privacy policies, subscription terms, acceptable-use policies, disclaimers, or other agreements. If separate terms apply to a product or service, those terms govern your use of that product or service.
2. Informational Website
Content available on the Website is provided for general informational purposes.
We may modify, remove, discontinue, or update Website content, products, features, services, descriptions, availability, pricing, or other information at any time without notice.
Nothing on the Website constitutes a guarantee that any product, feature, service, integration, proposed solution, or functionality will be available or remain available.
3. No Professional Advice
Unless expressly agreed otherwise in a separate written agreement, information provided through the Website does not constitute legal, financial, tax, accounting, engineering, medical, compliance, safety, or other regulated professional advice.
You are responsible for obtaining appropriate professional advice where necessary.
4. Requests for Solutions and Other Submissions
The Website may permit you to submit a request for a software solution, describe a business problem, contact us regarding a potential project, or otherwise provide information to us.
Submitting a request or contacting us:
- does not create a client, customer, partnership, fiduciary, employment, agency, or other professional relationship;
- does not obligate Advanced Foundry Tech to review, respond to, develop, purchase, license, or implement your proposal or request;
- does not constitute acceptance of any project or engagement; and
- does not create an obligation to keep unsolicited information confidential unless we separately agree in writing to confidentiality obligations.
Do not submit confidential, proprietary, trade-secret, export-controlled, classified, highly sensitive, or third-party restricted information through a general Website form unless we have expressly agreed in advance to receive it under appropriate protections.
If you submit ideas, suggestions, feedback, feature requests, or other non-confidential feedback regarding our Website, products, or services, you grant Advanced Foundry Tech a worldwide, perpetual, irrevocable, royalty-free right to use that feedback without restriction or compensation to you.
This provision does not transfer ownership of your independently owned intellectual property merely because you contact us regarding a potential project.
5. Intellectual Property
The Website and its contents, including software, text, graphics, designs, interfaces, logos, trademarks, service marks, trade names, images, documentation, and other materials, are owned by Advanced Foundry Tech or its licensors and are protected by applicable intellectual-property laws.
Except as expressly permitted by these Terms, you may not copy, reproduce, modify, distribute, publish, display, transmit, sell, license, create derivative works from, or commercially exploit Website content without prior written permission from Advanced Foundry Tech or the applicable rights holder.
“Advanced Foundry Tech,” associated logos, and product names may constitute trademarks or service marks of Advanced Foundry Tech LLC.
No license or right to use any trademark, copyright, patent, trade secret, or other intellectual property is granted except as expressly stated.
6. Acceptable Use
You may not use the Website to:
- violate applicable law or regulations;
- infringe or misappropriate another person's intellectual-property, privacy, publicity, contractual, or other rights;

7. Third-Party Websites and Services
The Website may contain links to third-party websites, platforms, services, or resources.
Advanced Foundry Tech does not control third-party services and is not responsible for their content, security, availability, privacy practices, products, or services.
A link does not necessarily constitute an endorsement, sponsorship, or affiliation.
Your use of third-party services is subject to their respective terms and policies.
8. Advanced Foundry Tech Products
The Website may provide links to software applications and other products developed or operated by Advanced Foundry Tech.
Those products may have separate Terms of Service, Privacy Policies, disclaimers, or other contractual terms.

9. Disclaimer of Warranties
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE WEBSITE AND ITS CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE.”
ADVANCED FOUNDRY TECH DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
WE DO NOT WARRANT THAT THE WEBSITE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, COMPLETE, ACCURATE, OR FREE FROM HARMFUL COMPONENTS.
Nothing in these Terms excludes warranties or rights that cannot lawfully be excluded.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ADVANCED FOUNDRY TECH LLC AND ITS MEMBERS, MANAGERS, OFFICERS, EMPLOYEES, CONTRACTORS, AGENTS, AFFILIATES, AND LICENSORS SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, REVENUE, DATA, BUSINESS OPPORTUNITIES, GOODWILL, OR USE, ARISING FROM OR RELATED TO YOUR USE OF OR INABILITY TO USE THE WEBSITE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE AGGREGATE LIABILITY OF ADVANCED FOUNDRY TECH ARISING FROM OR RELATING TO THE WEBSITE OR THESE TERMS SHALL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100).
These limitations apply regardless of the legal theory asserted and even if Advanced Foundry Tech has been advised of the possibility of such damages.
Some jurisdictions do not permit certain limitations of liability, so portions of this section may not apply to you.
11. Indemnification
To the extent permitted by applicable law, you agree to indemnify and hold harmless Advanced Foundry Tech LLC and its members, managers, officers, employees, contractors, agents, and affiliates from claims, damages, liabilities, losses, and reasonable costs and expenses arising from:
- your unlawful or unauthorized use of the Website;
- your violation of these Terms; or
- your infringement or misappropriation of another person's rights.
12. Privacy
Our collection and use of personal information through the Website are described in our Privacy Policy, which is incorporated into these Terms by reference where permitted by law.
13. Changes to These Terms
We may update these Terms from time to time.
When we make changes, we will update the “Last Updated” date above. Material changes may be communicated through the Website or by other appropriate means where required by law.
Your continued use of the Website after updated Terms become effective constitutes acceptance of the revised Terms to the extent permitted by applicable law.
14. Governing Law
These Terms are governed by the laws of the State of California, without regard to conflict-of-laws principles.
Subject to applicable law, any legal proceeding arising from or relating to these Terms or the Website shall be brought in a state or federal court having jurisdiction in San Diego County, California, and the parties consent to the jurisdiction and venue of those courts.
15. Severability
If any provision of these Terms is determined to be invalid or unenforceable, that provision shall be enforced to the maximum extent permitted and the remaining provisions shall remain in effect.
16. No Waiver
Failure by Advanced Foundry Tech to enforce any provision of these Terms does not constitute a waiver of that provision or any other right.
17. Entire Agreement
These Terms, together with policies expressly incorporated into them, constitute the agreement between you and Advanced Foundry Tech concerning use of the Website.
Separate agreements may govern particular products, services, projects, or business relationships.
